In McCleskey v. Kemp SCOTUS held that a capital defendant must show that the jury was motivated by racial prejudice in order to prove a violation of equal protection. 35 years later the time may be right to revisit this opinion. Racial inequity in the United States has created a groundwater effect where every facet of our society is “contaminated” by systemic structural racism, and capital juries are not isolated from this effect. Learn about litigation capital attorneys are working on to challenge the constitutionality of the death penalty based on structural racism and racial disparity.
